Can open AI models be used commercially?
Most can, but every licence has its own conditions.

Short answer. Mostly yes. The current Qwen, Gemma 4 and gpt-oss models are released under Apache 2.0, and Whisper’s code and weights are MIT-licensed, so commercial use is allowed subject to keeping notices. Others add conditions. Meta’s Llama 3.3 licence needs a “Built with Llama” notice, naming rules and compliance with an acceptable use policy, and a licence from Meta above 700 million monthly active users. Google’s Gemma Terms of Use, which cover Gemma 3 and earlier, require you to pass on a prohibited-use policy and let Google restrict violating use. Read the licence on the exact model you download, because a family’s licence can change between versions.

What Apache 2.0 gives you

Apache 2.0 grants a perpetual, worldwide, non-exclusive, no-charge, royalty-free, irrevocable copyright licence to reproduce, prepare derivative works of, display, perform, sublicense and distribute the work, plus a patent licence that ends if you start patent litigation over it. You must give recipients a copy of the licence, mark files you changed and keep notices. It has no copyleft: you do not have to publish your modifications. The work is provided “as is”, without warranty.

03

Where licences bite in an office

  • Redistribution: if a model is used only inside your office, most conditions about passing it on never trigger. They apply when you give the model to others or ship it inside a product.
  • Hosting for clients: if you offer a model to clients through an API or portal, check how the licence defines distribution. Google’s terms count a hosted service as distribution.
  • Attribution and naming: Llama 3.3 requires “Built with Llama” where you make available a product or service that contains it.
  • Training other models on outputs: the Gemma terms treat a model trained on Gemma outputs as a Model Derivative, and Llama 3.3 requires “Llama” at the start of the name of a model improved with its outputs. Apache 2.0 has no such rule.
  • Prohibited uses: Gemma 3 and Llama 3.3 each point to a policy that forbids listed uses.
04

Licences change between versions

Google’s Gemma 4 is released under Apache 2.0, while Gemma 3 and earlier remain under the Gemma Terms of Use, last modified on 1 April 2026. Keep a copy of the licence you accepted with each model version and read it again before you upgrade.

Where ANVE fits

ANVE One’s default model is Qwen 3.8 27B, which lists Apache 2.0 on Hugging Face. ANVE is pre-release. For any model you install yourself, read the licence on its card first.

Questions people ask

Can I fine-tune an Apache 2.0 model and keep the result private?
Yes. Apache 2.0 lets you prepare derivative works and does not require you to publish them. If you redistribute, you must include the licence and mark changes.
Does the Llama licence allow commercial use?
Yes, with conditions. You get a non-exclusive, worldwide, royalty-free licence, and must show “Built with Llama”, include the agreement and follow the acceptable use policy. If your products had more than 700 million monthly active users on the release date you need a licence from Meta, and Meta may terminate the licence for breach.
Does a licence say who owns what the model writes?
Mostly it does not. Google’s Gemma terms say it claims no rights in outputs, and Apache 2.0 is silent. See the page on who owns what a local model writes.
Where do I find the licence for a model?
On the model card, in the licence field and the repository files. Meta’s Llama 3.3 70B Instruct repository on Hugging Face is gated: you must accept the community licence before downloading.
