Data minimisation
Give a system, including an AI model, only the personal data the task needs.

Short answer. Data minimisation is the principle that personal data should be adequate, relevant and limited to what is necessary for the purpose. The wording comes from Article 5(1)(c) of the EU GDPR. India’s Digital Personal Data Protection Act, 2023 applies the same idea through consent: section 6(1) says consent must be limited to such personal data as is necessary for the specified purpose. The Act’s own worked example is a telemedicine app that asks for the user’s phone contact list as well; because contacts are not needed for telemedicine, her consent covers only the medical service. For AI, minimisation means giving a model only the part of a file it needs: the clause, not the whole contract; the visit notes, not the whole medical history. This is general information, not legal advice.

Minimising what goes into an AI tool

  • Redact names, Aadhaar, PAN and account numbers when the task does not need them.
  • Ask about a section, not the whole document: paste the indemnity clause, not the whole agreement.
  • Use the smallest useful extract: for a discharge summary, this visit’s notes, not ten years of history.
  • Connect an AI assistant to one folder, not the entire shared drive.
  • Turn off chat history or retention where the tool allows it, and set deletion dates.

Why it matters more with AI

AI tools invite people to upload whole folders, because answering from more material feels safer. Every extra record is one more thing that can be disclosed if access settings are wrong, retained by a vendor, or shown to the wrong user of a shared assistant. Minimising inputs shrinks what a breach can expose and what you must explain if a data principal asks under section 11.

Running models locally, as ANVE does, keeps documents on a device in the office, but a local index needs the same discipline about what goes into it. This page is general information, not legal advice. Ask a lawyer how the law applies to your office.

Questions people ask

Does data minimisation mean collecting nothing?
No. It means collecting and using what the purpose needs and no more. Too little data can also be a problem if it makes a record inaccurate.
Is pseudonymised data still personal data?
If the person can still be identified from it, alone or with other data, it is personal data under section 2(t) of the DPDP Act. Remove the identifiers the task does not need.
Does local AI remove the need to minimise?
No. It takes the vendor out of the picture, but staff access, retention and accuracy duties still apply to whatever you index.
