Purpose limitation
Use personal data for the purpose you collected it for, and not for something new.

Short answer. Purpose limitation is the principle that personal data should be collected for specified, explicit and legitimate purposes and not used later in a way incompatible with them. The phrase comes from Article 5(1)(b) of the EU GDPR. India’s Digital Personal Data Protection Act, 2023 does not use the phrase but builds the idea in: the notice must state the purpose (section 5), consent covers processing for the “specified purpose” (sections 2(za) and 6(1)), and data must be erased once that purpose is no longer served (section 8(7)). The Government’s explainer on the DPDP Rules lists purpose limitation among the Act’s core principles. For AI, it means asking whether feeding client files into a model is part of what the client’s data was collected for. This is general information, not legal advice.

Two worked examples from the Act

In the Act’s worked example for section 7(a), a woman shares her details with a real estate broker to find a rented flat. The broker may use them for that, but once she says she no longer needs help, the broker must stop processing them.

In the Act’s worked example for section 8(7), an online marketplace helps a user sell her used car. Once the sale is concluded, the marketplace should no longer retain her personal data. A bank, by contrast, may keep a closed account’s identity records because a law requires it.

What it means for AI in an office

  • Client documents collected to file a return are not automatically available for training an internal model or building a mailing list.
  • Meeting recordings made for minutes should not quietly become material for assessing staff.
  • If a vendor’s terms let it use your prompts to improve its models, that is a use beyond the purpose you collected the data for.
  • When the purpose ends, delete the documents from the AI index as well as from the file share.
  • On ANVE, models run on the device by default; cloud models are added only by an administrator and their answers are labelled. The office still decides what each document may be used for.
04

Before you reuse data

Ask three questions: what purpose did the notice or engagement state, does the new AI use fit within it, and if not, is there another lawful basis such as fresh consent? Using synthetic or properly anonymised documents for testing avoids most of these questions. This page is general information, not legal advice. Ask a lawyer how the law applies to your office.

05

Questions people ask

Is purpose limitation in the DPDP Act?
Not by name. The Act achieves it through the specified purpose in sections 5, 6 and 7 and the erasure duty in section 8(7). The Government’s explainer on the Rules names it as one of the Act’s core principles.
Can we use old client files to test an AI tool?
Only if that use fits the purpose the data was collected for, or you have another lawful basis. Synthetic or anonymised test files avoid the question.
What is the difference from data minimisation?
Purpose limitation controls what you use data for; data minimisation controls how much data you use for that purpose.
